PATRICK-MURRAY ADMINISTRATION FILES BILL TO REDUCE GUN VIOLENCE IN THE COMMONWEALTH

Legislation seeks to reduce supply of illegal guns, increase penalties and comply with federal requirements

BOSTON– Wednesday, May 6, 2009 – Continuing Governor Deval Patrick’s efforts to reduce gun violence and strengthen public safety, Public Safety Secretary Kevin M. Burke today announced that the Patrick-Murray Administration has filed a bill to give police and prosecutors more tools to tackle illegal gun use and make the Commonwealth a safer place to live, work, and raise families.

“We see and feel the effects gun violence has on our families and our communities throughout Massachusetts – and we must do everything in our power to help prevent it,” said Governor Patrick. “This legislation gives law enforcement the critical tools they need, and sends a very strong message that illegal gun use will not be tolerated.”

The Governor's legislation addresses a decision issued by the Supreme Judicial Court on May 4. The SJC held that so-called 58A dangerousness hearings, the court procedure that allows prosecutors to ask judges to hold dangerous criminal defendants without bail, does not apply to charges of illegal possession of a firearm. Governor Patrick's bill makes this procedure available to prosecutors for charges that involve illegal possession, use, or trafficking of guns.

In addition, the Governor’s legislation makes it a felony to possess a gun while committing certain crimes that might otherwise be misdemeanors, and removes the requirement that state prosecutors must prove a gun is operable to be considered a firearm, a change that will bring state law in line with the federal regulations.

“Our law enforcement officers do great work making our streets safe using the tools they have,” said Public Safety Secretary Kevin M. Burke. “This gun legislation helps take some of the criminal firepower off the streets and builds in a layer of protection for us all by giving the courts the right to detain anyone who uses a gun to commit a crime – even if it’s a misdemeanor.”

"The changes to the state's gun laws are a common sense approach to providing police officers and court officials with more powerful tools to maintain the safety of our residents by keeping criminals and guns off the streets,” said Mayor Thomas Menino. “Through this tough approach, we address where the guns come from and make it harder for criminals with guns to suffer only misdemeanor charges."

"Of about 1500 firearms seized and traced in Massachusetts two years ago, more than 1200 came from another state with gun laws more lax than our own," said District Attorney Dan Conley. "But more than 20% of those traced guns came from right here in the Commonwealth, and that means we still have work to do here at home."

Specifically, the legislation would:

Gun Reforms

* Limit gun purchases to one gun a month in order to reduce gun trafficking by “straw purchasers” who purchase firearms for convicted felons or other prohibited buyers.

 

* Create a new crime (10-year felony) for possessing a gun while committing a misdemeanor that involves the use of force.

 

* Upon motion by the district attorney, the legislation allows defendants charged with possessing, using, or trafficking illegal firearms to be held without bail pending trial. The Supreme Judicial Court ruled on May 4th that current statute does not allow for pre-trial detention for charges involving illegal possession of a firearm. The Governor’s legislation clarifies the current statute, giving prosecutors the tools they need to help end the cycle of violence and retaliation.

 

* Change definition of “firearm” to parallel federal law, relieving Commonwealth from proving that gun is operable.

Secondary Gun Sales


* Requires individuals who resell their guns to conduct the transaction at a licensed dealer so that the transaction can be entered into the electronic firearms database for better tracking of secondary sales.

Machine Gun Reforms


* Clarifies laws to prohibit anyone other than a person with a machine gun license or a police officer receiving training from handling a machine gun.
* The Secretary of Public Safety and Security will promulgate new regulations to prohibit use of machine guns at gun shows or exhibitions and to narrow definition of “bona fide collector.”

Brady Bill Changes


* Requires transmission of court records of involuntary commitments to state central criminal record repository for inclusion in the National Instant Criminal Background Check System (NICS), and otherwise amends state law to comply with federal NICS Improvement Amendments Act of 2007.
* This provision will ensure the Commonwealth does not lose valuable federal grant funding

Governor Files Anti-Gun Bill in the Bay State
Please Stand-Up and Make Your Voices Heard!

Yesterday, Governor Deval Patrick (D) filed legislation that would severely curtail the rights of gun owners in the Commonwealth.  The bill entitled, “An Act to Reduce Firearm Violence,” is in essence a repeat performance of Chapter 180 of the Acts of 1998.

Among other things, this bill would:

 

  • Limit firearm purchases to one per 30-day period;
  • Require the private transfer of all firearms to be conducted through a federally licensed firearms dealer, and;
  • Allow the Colonel of the Department of State Police to destroy surrendered firearms instead of auctioning them for sale.


If you don't remember, Chapter 180 of the Acts of 1998 created some of the most confusing and ill-advised set of gun laws in the country. The vast majority of those new laws attacked lawful gun owners and did little, if anything, to address violent crime.  Since enactment, the only result has been an 85% decrease in the number of lawfully licensed gun owners in Massachusetts and a dramatic increase in crime.

Governor Patrick Files H.4102


On Wednesday, May 06, 2009 the Patrick Administration filed H 4102"An Act to Reduce Firearm Violence" but can truly only be described as Chapter 180 Part II. This bill has been assigned to the Joint Committee on the Judiciary.  The existing persecutorial gun laws in Massachusetts were passed in 1998 (Chapter 180 of the Acts of 1998). The result has been an 85% reduction in lawfully licensed gun owners and a drastic INCREASE in gun related crime.

According to the Massachusetts Department of Public Health's 2007 ISP Report, gun related deaths and injuries categories have increased in the following manner:

79 % INCREASE in homicide related firearm deaths since 1998.
72 % INCREASE in firearm assault related injuries since 1998.
243 % INCREASE in assault related firearm hospital discharges since 1998.
331 % INCREASE in firearm assault related emergency room visits since 1999 (Category began in '99).
590 % INCREASE in firearm assault outpatient observations since 2001 (Category began in '01).

The record of reducing crime via "gun control" is a confirmed failed social experiment within the Commonwealth. With these facts in mind, it is incomprehensible that our Governor would seek to pile twenty-three more sections of more "gun control" legislation on top of the existing disastrous laws.

Perhaps the most egregious part of this bill is the Governor's proposal to send lawfully licensed citizens to prison for two and half years for legally purchasing two firearms in a one month period! How can any representative of the lawful people of the Commonwealth propose to reduce crime by putting the innocent in prison?

"We need to focus on reforming the State's gun laws through the Civil Rights and Public Safety Act first and foremost," said Jim Wallace Executive Director of Gun Owners' Action League. "We need to give a concerted effort to completely separate, in statute, the lawful possession issues and the criminal enforcement issues. Only by doing that will we be able to ensure the protection of lawful citizens and begin to successfully punish the human criminal element, thus reducing crime."

GOAL urges all of our members to contact their local legislators and the Joint Committee on the Judiciary and urge them to reject any further "gun control" proposals and ask them to support GOAL's reform bill H.2259, the Civil Rights and Public Safety Act instead. H.2202, Automatic Weapons Bill or General Gun Ban?
 


Recently GOAL obtained a copy of H.2202 "An Act to Close the Automatic Weapon Loophole" bill. The legislation was filed by Representative Antonio Cabral of New Bedford. The bill appears to have no cosponsors. At first glance one would logically come to the conclusion that the bill has something to do with machineguns. Unfortunately, you would be wrong. It is actually a potential ban on everything other than automatic firearms.


The very first section of the bill changes the Commonwealth's definition of "Assault Weapon" by deleting the exemptions that exist for manual action guns. The proposed change also does away with an important exemption that GOAL had put into law in our 2004 reform bill (Chapter 150 of the Acts of 2004).

The exemption was Appendix A of 18 U.S.C. 922, part of the federal assault weapons ban laws that were set to expire in 2004. The Appendix contained a list of hundreds of guns that could legally never be considered as "assault weapons".

Some examples of the guns on the list are Ruger Red Label Shotgun, Perrazi Sporting Classic O/U Shotgun, Browning Citori O/U Shotgun, Remington 870 Youth Model, Ancshutz Match Rifle, Thompson/Center Contender Carbine. Knowing the federal ban was set to expire and the Massachusetts ban was not, GOAL successfully worked to permanently attach Appendix A to the Massachusetts exemptions. H.2202 proposes to do away with that exemption.


The next two sections of the bill inserts language into the license to carry law (Chapter 140, Section 131) essentially banning the purchase, renting, leasing, borrowing, possession and carrying of assault weapons.

Section four of the bill is more than a little confusing as it deals with club licenses. The language removes an exemption in the law that currently allows the removal of large capacity weapons or large capacity feeding devices from the premises (club) for the purpose of "hunting in accordance with the provisions of chapter 131."

The bill then moves to change the minimum sentencing for possession firearm (handgun), rifle or shotgun form 2 ˝ years to "not less than three years." The minimum sentencing for drug and violent crimes in conjunction with gun crimes is increased from three years to a minimum of five years. It also intends to do away with the ability to serve concurrent sentences for certain crimes.

The bill clearly has nothing to do with machineguns (automatic weapons), but rather is intended to ban certain semi-automatic guns (assault weapons). Perhaps even more sinister is that by proposing to remove the crucial exemptions in the legal definition of "assault weapon" it is intentionally opening the door to label most any gun an assault weapon and thus potentially banning anything. If this is not the intention, then why remove the exemptions?

H.2202 is currently within the Joint Committee on Public Safety and Homeland Security. We urge our members to contact the Committee members and ask them to oppose this blatant attempt to open the door for banning the possession of guns by lawful citizens.
 

 
Microstamping Bill Comes to Massachusetts
 


This is one bill that we have been waiting to appear here in Massachusetts. H.2247 "An Act to Improve the Ballistic Database through Microstamping Ammunition." Gun owners have seen these type of bills pop up all over the country for the past few years. Although there was a late file microstamping bill last session, it never got out of committee. H.2247 has been filed through the normal process and has ten cosponsors. No surprise that one of the names is Boston Mayor Thomas Menino.

This bill proposes to add language to Section 11E of Chapter 269 (Current serial numbers on firearms law.) In short the bill would mandate that all semiautomatic handguns manufactured or delivered to a licensed dealer in Massachusetts as of January 1, 2010 would be required to be capable of microstamping any ammunition fired from them.

One of the key components is the term "delivered to any licensed dealer" The bill doesn't just affect new semiautomatic handguns, it bans the delivery of all such handguns to a licensed dealer. The language could effectually ban a licensed dealer from accepting a noncompliant semiautomatic under any circumstances. Trades in, consignments, surrenders, storage, transfers, etc. would all be banned through a licensed dealer. There is supposedly an exemption in (D) to cover existing handguns, but we have seen how Massachusetts government interprets law and the exemption language might mean something different to a government official than it does to a lawful gun owner. We have seen it happen.

As for the so-called technology, the National Shooting Sports Foundation has done a great job at debunking it. The following is taken from their website www.NSSF.org:

A recent independent, peer-reviewed, study published in the professional scholarly journal for forensic firearms examiners proved that the technology of microstamping is unreliable and does not function as the patent holder claims. It can be easily defeated in mere seconds using common household tools or criminals could simply switch the engraved firing pin for readily available unmarked spare parts, thereby circumventing the technology.

Experts at the University of California, Davis, recently finished a study of the technology which was requested and funded by the California State Legislature. The conclusions about the technology are straightforward and direct. The researchers found this patented technology "flawed" and concluded that "At the current time it is not recommended that a mandate for implementation of this technology in all semiautomatic handguns in the state of California be made. Further testing, analysis and evaluation is required."

NSSF and other groups, including major law enforcement organizations, are opposed to this unproven and unreliable technology. The cost of this dubious technology is a great concern to firearms owners and taxpayers alike. Microstamping legislation in California would not only have forced consumers of firearms to pay exorbitant price increases-as much as $200 per firearm- to cover the increased cost of microstamping, but substantially higher taxes for the cost of microstamped law enforcement guns.

H.2287 the Anti RKBA Buffet
 


H.2287 "An Act Relative to Firearms in the Commonwealth" is a re-file from the last legislative session. As stated in my title, it is a virtual buffet of anti RKBA legislation. Rather than taking up a lot of space with detailed explanations, I'll simply give a bullet point list of the proposals in the bill:

·    A complete list of every handgun owned must be supplied to your licensing authority;
·    $250,000 insurance policy on every handgun to cover any harm or damage that might arise from the use;
·    Place a member of Stop Handgun Violence on the state's Gun Control Advisory Board;
·    Owners of guns to make lost or stolen reports or face heavy fines;
·    Changing the mandatory training requirements for handguns to be a minimum of 20 hours long to include four hours of "practical shooting";
·    One handgun a month;
·    Solenoid use-limitation devices, voice recognition devices, automated fingerprint systems for handguns;
·    Increasing the penalties for multiple unlawful sales.
